Terms of service & general conditions 

Version 1.1 

§1. Definitions, Acceptance of terms and relevance

1.1 Definitions:

Kentic: Kentic / Kornelis Bastiaan Huijgen IČO: 75230771 operating as Kentic and expatinsurance.cz (known hereafter only as Kentic) providing service(s) to a customer subject to the following Terms of Service.

Customer: The person or entity with whom an agreement for the provision of services is closed, either verbally or in writing. This may include but is not limited to: general assistance services, real estate finding service, translations, insurance brokerage etc. 

Agreement: a written or verbal agreement made between the customer and Kentic stating specific services to be provided by Kentic to the customer. Unless otherwise agreed, all of the provisions from these terms of service apply to all agreements agreed upon by Kentic.

Real Estate: a property (apartment, office or other) that may or may not be available for rent or sale on the market.

Conditions or Terms: Terms of service under which Kentic provides all of their services to any (potential) customer. All deliveries are subject to these terms of service.

Insurance: insurance as provided by one of Kentic’s partners, normally insurance companies registered with the Czech National Bank as insurance providers according to Czech law.

1.2 Acceptance of terms

In order to place an order and purchase any of the Services or before agreeing with Kentic upon a general agreement, the Customer must read these terms and conditions, and agree to be legally bound by the terms and conditions imposed on the Customer by this document.

Kentic and the customer can agree to different terms of service in an agreement or can agree upon the delivery of services under different terms of service.

Kentic does not accept terms of service from any other party, if these terms conflict with these terms of service.

§2. Services provided and delivered by Kentic and commitment to the customer

Kentic provides a wide variety of services according to the customer’s needs. Some of those services and their terms and conditions are: 

2.1 Assistance services: Kentic will undertake to do everything reasonable within its power to provide the Customer with the most suitable assistance, helping the Customer where possible with gathering the necessary documents, translating, negotiating and dealing with (semi-) governmental institutions and other third parties. Kentic will keep the Customer informed on process and progress.

2.2 Real estate finding services: Kentic will perform the Customer-specific search, online and within Kentic’s extensive network. The results of the search will be presented to the Customer in a form of a longlist. The Customer will decide which apartments on the long-list, if any, he/she would like to view, and Kentic makes the necessary arrangements for such viewings; Kentic continues to update the list with new properties, until the customer finds a suitable apartment. Kentic undertakes to do everything reasonable within its power to provide the Customer with the most suitable apartment, negotiating the best possible price and conditions and constantly keeping the Customer informed. Once the Customer has decided on the apartment he/she would like to rent, Kentic will review the contract and ensure that its conditions are lawful, reflect previously negotiated terms and are in Customer’s best interests. Extra services may be included and/or agreed upon, according to the Customer’s wishes.

2.3 Insurance brokerage: Kentic will provide the customer, if possible, with several options from different insurance companies so that the customer has a choice which policy most suits his or her needs. Kentic will get a commission from the insurance company when the customer decides to buy a certain insurance policy and Kentic will not, unless otherwise agreed, charge the customer any fee for the closure of the policy.

§3. Commitment from the customer

3.1 Assistance services: The Customer commits to keeping Kentic up-to-date with any changes to his/her requirements and/or needs, legal situation, status, etc. etc. Should the Customer contact any third parties regarding the abovementioned services also, he/she shall inform Kentic of such contact. If the Customer at any point decides to pursue the process that Kentic had started for the Customer alone, Kentic shall be entitled to the fee as per §4 of this agreement, unless otherwise agreed.

3.2 Real estate finding service: The Customer commits to keeping Kentic up-to-date with any changes to his/her requirements and/or needs. Should the Customer contact any third parties regarding the abovementioned search, he/she shall inform Kentic of such contact and the properties it concerns. The customer realises that contacting a third party directly will make it impossible for Kentic to be involved in that further process, and the customer will lose the right to any discounts given by Kentic. If within 4 months of this agreement the Customer closes a lease, with or without Kentic’s involvement, on any property that has been presented/offered to the Customer by Kentic, Kentic shall still be entitled to the fee as per §4 of this agreement.

3.3 Insurance brokerage: The customer will provide Kentic with truthful information regarding his or her situation and/or the situation of the person or object to be insured. Failing to do so may result in the insurance policy becoming void 

§4.Fees and payment

4.1 Upon providing the customer with assistance, closing an agreement or contract on an apartment, house, office or insurance etc. , the Customer shall pay Kentic a one-time-fee as agreed in an agreement as mentioned before or according to the Kentic pricelist, less any discounts that may apply.

4.2 For the real estate finding service the standard fee is equal to one months’ rent not including fees for utilities. Kentic however by default offers a discount to customers that sign an agreement as mentioned.

4.3 Kentic is not a VAT payer, so no VAT will be charged to the Customer. 

4.4 In principle all invoices are payable into our mBusiness account no. 670100-2206064578/6210 in Czech crowns. Alternatively Kentic can accept payments in Cash in Czech crowns or Euro’s (the daily rate of www.cnb.cz will be used) or Kentic can accept payment in Euro’s into our Dutch bank account with ING bank in Amsterdam.

4.5 The fee is payable within 14 days of closure of the agreement unless otherwise agreed. The Customer is aware of the fact and agrees to that the fee does not and shall not include any administrative fees charged by (semi-) governmental or commercial third parties (exception: any third party commission regarding the real estate search service as described). 

4.6 Unless otherwise agreed, there will be no deposit up front. 

4.7 In case the customer fails to pay an invoice or part of an invoice to Kentic, Kentic shall notice the customer first by one reminder per e-mail, followed by a registered letter by mail if possible. In case the customer fails to pay the invoice after this last warning, the customer will have the obligation to pay all cost, including third party fees, associated with the collection of the amount with or without the help of a collection agency or the court.

§5. Special offers and Discounts

5.1 All special offers and discounts must be agreed upon in advance while you order. A Customer cannot claim them after an agreement has been signed. Every special offer or discount has specific conditions and terms. 

5.2 For customers who belong to a company or organisation Kentic has a general agreement with or for, the discount is only applicable upon the agreement of this company or organisation and if the customer mentions his or her relationship to this company or organisation before signing the agreement...

§6. Liability and Force Majeure

6.1 Kentic accepts no liability for any damage or loss the Customer may experience related to the services mentioned beyond the agreed fee in §4. 

6.2 Kentic provides service to the best of its abilities based upon our experience, knowledge and research. Kentic is committed to keeping their consultants informed on new developments and situations. Assistance in further disputes that might arise with any third party will be offered by Kentic within reason, and we commit ourselves to keeping all our Customers satisfied. 

6.3 Real Estate finding service: Kentic accepts no liability for any hidden defects, faults or disappointing features of the apartment. Kentic provides a search service only and accepts no liability for the future relationship between the customer and the landlord or any other third parties. Assistance in communicating with the landlord can however be provided within reason.

6.4 Assistance services: Kentic is not liable for the decision any (semi-) governmental institution might make. If for example the foreign police decides for whatever reason to deny the Customer a visa or residence permit, this does not dismiss the Customer from paying the fee to Kentic mentioned in §4.

6.5 Kentic is relies partly on the services of our trusted third parties, no matter how carefully select our partners, Kentic cannot accept any liability for their behaviour, service level, financial situation or failure to (partly) deliver their services. 

6.6 In case force majeure makes it impossible for Kentic to complete the service for the customer or makes it impossible to continue a project, the agreement between the customer and the customer can be terminated unilaterally by Kentic.

§7. Termination of a contract

7.1 Both Kentic as well as the customer are allowed to terminate an agreement by informing the other party in writing at any time. Termination of the agreement does not relieve the Customer from payment for services that have already been ordered by the customer or provided to the Customer, unless otherwise agreed.

7.2 Agreements are also terminated upon the payment of the fee by the Customer to Kentic.

§8.  Protection of personal data and Intellectual property

8.1 Protection of the personal data. 

The customer consents that the data he or she provides to Kentic can be used for the requested service, and may be shared with third parties for the purpose of successfully completing the project (ie. the owner of an apartment). All data shall be processed in accordance with the law for the protection of personal data and Kentic will never share your data with any third party other than for the purpose of requested services. Kentic may keep your personal data for the purpose of informing you of our activities and services.

8.2 Intellectual property

All documents provided by Kentic to the customer, unless otherwise agreed, remain the intellectual property of Kentic, and cannot be shared with any third party by the customer without Kentic’s prior written approval.

§9.  Reclamation and disputes

In case a customer believes the services provided to him or her, have not been adequate and do not fulfil his or her needs and or requirements, or in case the customer feels the amount charged for the services was wrongly calculated, the customer has the right to file a written complaint with Kentic up to 14 days after the delivery. Kentic will investigate the matter and give the customer a written reply. The filing of a complaint shall not have an influence on the payment or payment term of an invoice; any difference will be credited to the customer after the investigation is concluded.

§10.  Change of terms and conditions 

Kentic has the right to change these terms without prior notice to the customer. The most current version (incl. version number) of these terms is always available on our website.

In case there is a running agreement with a customer, the customer has the right to terminate the agreement in case the new terms are not acceptable to him or her, or agree with Kentic the previous terms apply. 

§11. Governing law

It is the intention of the parties to this Agreement that this Agreement and the performance under this Agreement, and all suits and special proceedings under this Agreement, be construed in accordance with and governed, to the exclusion of the law of any other forum, by the laws of the Czech Republic.
